TERMS AND CONDITIONS
ACKNOWLEDGEMENT AND CONSENT
As a participant with activities held at Badyal Farm, 5131 Interprovincial Hwy, Abbotsford, BC V3G 2P5 [herein “property venue”], I recognize and acknowledge that there are certain risks of damages, including but not limited to physical injury, death, damages, property damage, or loss, which I may sustain or cause as a result of participating in any and all activities connected with the property venue, the use of the facilities or equipment, or any program I attend at the property venue.
I also consent to, and authorize Sungiven Foods, to photograph, video record and audio record me or otherwise use my image, including my name, voice or both in the photographs and video recordings [“my image”]. I hereby grant the Sungiven Foods the right to reproduce, use, exhibit, post, display, broadcast and / or distribute my image on / in Sungiven Food affiliated social media accounts, website and any marketing and promotional materials; Photographs, video images and voice recordings are the property of the Sungiven Foods.
WAIVER / RELEASE
I accept all risks and agree to waive and relinquish all claims that I may have for injuries or damages as a result of participating in activities connected with the property venue, the use of the facilities or equipment, or any program I attend at the property venue against Sungiven Foods and Badyal Farm. I do hereby release and discharge Sungiven Foods and Badyal Farm from any and all claims for injuries and loss, including physical injury, death, damages, property damage, or loss which may have or may in future occur to me as a result of participating in events for Sungiven Foods.
I waive all copyright interest including moral rights, and any rights to claim royalties, or any other form of compensation or interest arising from Sungiven Food’s use of my image. I forever release, discharge, indemnify and defend the Sungiven Foods from and against any and all claims and demands arising out of, or in connection with, the use of my image or recording, including but not limited to, any claims for infringement of privacy, defamation, appropriation of personality, or copyright infringement.
Sungiven Foods reserve the right of final decision.
